Title: Media Consent and Photography at Baseworks Events

This post was created in response to the following comment by Clementine on the group feed:

“Hey! I just saw an ad for baseworks that included an image of someone from our group. I just wanted to check that our images are only being used with consent. I am a public figure and I don’t want images of me used in Baseworks advertising.”

It’s a fair question, and one worth addressing in detail for everyone’s reference.


We take media consent seriously. Our process involves three separate steps, each with an opt-out:

  1. At registration — Before completing any purchase, the checkout page states that by proceeding, you agree to our Terms of Service (linked directly beneath the purchase button). Those terms include a participation waiver with a media release covering photographs and video from our events for promotional and educational use.

  2. Before the first session — We do not proceed with any event until every participant signs a standalone participation waiver covering assumption of risk, medical disclosure, personal responsibility, media release, and liability. The media release addresses the use of photographs, video, and other media from our events. It also specifies that participants who do not wish to appear physically recognizable will inform the facilitators and photographers before any filming begins.

  3. On site — Whenever a photographer or videographer is present for focused photography or video, we ask the group whether anyone does not wish to be physically recognizable in the material being captured. Clementine was not present at either of the two sessions where focused photography and video took place for this cohort.

Each step is designed to give every participant a clear opportunity to let us know their preference. No one has to wait until after the fact to raise this — the process is built so that it can be addressed in advance, at multiple points.

We use event photographs across our website, blog posts, educational and promotional materials to present what we do clearly and honestly — as any educational organization would. We have no interest in using anyone’s image in a way that misrepresents their involvement or the nature of our work.

Moving forward, the group feed and forum are spaces for sharing observations, questions, and discussions about your experience with the practice and the program content. For administrative or logistical questions — including participation terms, consent, billing, or similar matters — we’d ask that you reach out to us by email so we can address them through the appropriate channel.

Nous prenons le consentement médiatique au sérieux. Notre processus comporte trois étapes distinctes, chacune offrant une option de retrait :

  1. À l’inscription — Avant de finaliser tout achat, la page de paiement indique qu’en procédant, vous acceptez nos Conditions d’utilisation (lien affiché directement sous le bouton d’achat). Sur place — Chaque fois qu’un photographe ou vidéaste est présent pour des prises de vue ciblées, nous demandons au groupe si quelqu’un ne souhaite pas être physiquement reconnaissable dans le matériel capturé. Clementine n’était présente à aucune des deux séances où des prises de vue ciblées ont eu lieu pour cette cohorte.

Chaque étape est conçue pour offrir à chaque participant une occasion claire de nous faire part de sa préférence. Personne n’a à attendre après coup pour soulever cette question — le processus est construit de manière à ce qu’elle puisse être abordée à l’avance, à plusieurs reprises.

Nous utilisons les photographies de nos événements sur notre site web, nos articles de blogue, ainsi que dans nos matériels éducatifs et promotionnels pour présenter ce que nous faisons de manière claire et honnête — comme toute organisation éducative le ferait. Nous n’avons aucun intérêt à utiliser l’image de qui que ce soit d’une manière qui dénaturerait sa participation ou la nature de notre travail.

Hi. I didn’t realize that I had signed that. I do not give my consent and I do not want my photos used. I think if you are planning to use our images you should verbally indicate that that is on the form. Otherwise it feels very sneaky. It will be damaging to my career if my image is used that way. So again, please do not use my image in your advertising.

Another participant’s comment corroborating the on-site process:

@clementinemorrigan It was made very clear, both times the photographer was at the studio to take pictures, that we would not appear on the pictures if we did not want to. Technology is great, that way.

Response:

Nothing about our process is intended to be sneaky or misleading — the three-step consent process exists specifically to ensure transparency. The media release is one section of a broader participation waiver that covers assumption of risk, medical disclosure, personal responsibility, and liability. It is presented clearly and requires a signature before anyone can participate.

As @mimi.robert.trudel noted, the on-site step was clearly communicated during both sessions in which focused photography took place. You were not present at either of those sessions, which is why you may not have experienced that part of the process directly.

We understand that participation forms cover a lot of ground, and that individual sections can be overlooked. That is exactly why we have three separate steps rather than one — so that there are multiple opportunities to raise preferences before any filming begins.

To be clear: you do not appear in any of the focused photography or video from this cohort. We acknowledge your preference and will respect it in all current and future materials.

@patrick thank you for the clarity! Sorry I didn’t read the whole linked policy, as it was a lot of info and I was feeling very anxious about the situation. Since I knew the sessions had been filmed, I was worried the images were coming from there. I see I misunderstood. Thanks for clarifying.
